Marine Trade v Pioneer: Payer beware

Overview

The recent judgment in Marine Trade v Pioneer provides a stark warning to parties who dispute that payment is due to a contractual counterparty but who, for good reason, make the disputed payment under protest, with a view to reclaiming the amounts so paid in subsequent litigation.
