Legal fees to be slashed in personal injury claims

Lord Justice Jackson's report published today (Thursday 14
January 2010) on legal costs in England and Wales could see the end of the gravy train for claimant personal injury lawyers whose fees often exceed the damages awarded.
This briefing is just a taster of the key recommendations contained in the 584 page report specifically impacting on personal injury claims. The recommendations include:
- fixed fees in personal injury claims in the fast track up to £25,000
- 'one way cost shifting' in personal injury claims
- success fees and after the event insurance premiums no longer recoverable from the losing party
- no increase in the small claims limit
- increase in general damages of 10 per cent
- referral fees to be banned or limited changes to part 36
