Security Matters: ICO stresses breach disclosure once again

Overview

"Report data breaches or risk tougher sanctions, warns the ICO"

On 27th January the Information Commissioner published a new press release in which he stressed once again the need for data controllers to report security breaches and data loss to his office.

Those of us who have been following developments in this area will know that the ICO has repeatedly stated its view that breach disclosure is a formal component of good practice in data handling and that decisions to bury the bad news will be punished by tougher regulatory responses and sanctions; as the press release states "the ICO is warning that organisations may face tougher sanctions if they fail to report security breaches which subsequently come to light... those that try to cover up breaches which we subsequently become aware of are likely to face tougher regulatory sanctions."
