Macfarlanes considers the recent case of Coys of Kensington Automobiles v Pugliese in which the court held that by simply signing an auction form the defendant had consented to an exclusive jurisdiction clause set out in the claimants’ standard terms and conditions.
The case sets out the rules on whether an English court will give effect to an exclusive jurisdiction clause and is a good example of those rules in operation.
