Unfair dismissal – a timely reminder

Overview

The Statutory Dispute Resolution Procedures; remember them? Just over a year has now passed since their abolition, so Stephenson Harwood has chosen this appropriate time to take a fresh look at the basics of the law around dismissals.

The Employment Rights Act 1996 (ERA) gives qualifying employees the right not to be unfairly dismissed. Generally, employees must have over one year’s service to qualify for this right, although there are some exceptions to this. An unfair dismissal claim must be brought within three months of the effective date of termination.
