Overview
After almost four years of discussion, revised UNCITRAL Arbitration Rules look likely to be released within the next few weeks. The revision satisfies the real need that had emerged over time to update the Rules to meet the needs of their users and to reflect common practice. While changes were necessary and overdue, it was emphasised that any revisions made should respect the original drafting style of the Rules and the spirit and flexibility of the text.
Hogan Lovells has followed the revision process since its beginnings and, during the 45th, the 50th and the most recent session (the 52nd), attended discussions on behalf of the LCIA1. As the review process draws to a close, we can now examine whether the final product will meet the initial requirements. On the surface, the changes likely to be made seem largely sensible and constructive, however, a theme of institutionalisation has crept into the Rules and the long consultation process has left some dense drafting in its wake.
