Overview
The UK Supreme Court has abolished the long-standing immunity that experts have enjoyed in respect of liability for negligence arising from giving or assisting with evidence in litigation. This follows the House of Lords’ decision in 2002 that abolished immunity from negligence suits for advocates.
Herbert Smith looks at both 2011’s Jones v Kaney case and 2002’s Hall v Simons case and considers the impact both may have on negligence claims against experts.
