Thailand makes significant amends to Trademark Act

Overview

As Thailand's Trademark Act of 1991 fails to meet current international standards, a new bill is being drafted to redress some of the shortcomings of the Act and to prepare for Thailand becoming a member of the Madrid Protocol.


The Bill was approved by the Cabinet on 22 November and will now be submitted to Parliament for further consideration and approval. If approved by Parliament, it will be announced in the Government Gazette before it goes into effect, which is likely to be in 2012-2013.   • distinctiveness of shape or configuration, scent and sound;

  • acquired distinctiveness;

  • multi-class application;

  • process of registration;

  • time frame; and

  • fees.
