Overview

Taylor Wessing summarises the key issues in taking and enforcing security in the main European jurisdictions and provides a general guide.

Additionally, set out is a comparison of the major lending and enforcement issues in the US and England as against those which exist in continental Europe.

For instance, in the US and England, it is possible to obtain security over existing and future assets. This is often not the case in continental Europe. Where assets are constantly changing, there is often a requirement to file updated details on a regular basis.
