Strength in numbers: China finalises merger control rules

Overview

On 2 September 2011, China's Ministry of Commerce published and promulgated the 'Provisional Rules on the Assessment of the Competitive Effects of a Concentration of Business Operators'. The Rules provide a written consolidation of MOFCOM's methodology to date. They also show how the merger control regime is being brought another step closer in its alignment with similarly broad-reaching antitrust regimes, such as the EU and U.S.

Allen & Overy's China office offer a general overview of the new rules as well as a more detailed study assessing market control power; how market concentration levels are measured; and some of the regulations' perceived failings.
