Safeguards against injustice? Court refuses to stay civil claim until foreign criminal proceedings determined

Overview

In the recent case of Akcine Bendrove Bankas Snoras (in bankruptcy) v Antonov, the Commercial Court refused to grant a stay of an English civil claim pending determination of extradition proceedings and criminal investigations in Lithuania. The Court was not satisfied that there would be a real risk of injustice and prejudice to the Defendant if the civil case were to continue.

Macfarlanes details the case's background and decision; and outlines why an Applicant may have a high hurdle to overcome if he is to satisfy the Court that it is in the interests of justice to stay civil proceedings until overlapping criminal proceedings are concluded.
