Overview
If a tenant is in administration and the administrators are using the leasehold premises for the benefit of creditors – rent for the period of use is automatically payable as an expense of the administration.
The recent High Court case of Goldacre (Offices) Limited v Nortel Networks UK Limited (in administration) has provided some welcome clarity on the question of when administrators must pay the rent and other expenses for their use of leased premises.
