Radical plans announced to speed up UK employment tribunal process and reduce number of claims

Overview

On 23rd November, the Government announced radical plans for reforming the employment tribunal system. The Government hopes to succeed where previous governments have failed by reducing the number of employment tribunal claims and speeding up the tribunal process, thereby lessening the burgeoning cost to both employers and the taxpayer. In its response, the Government has confirmed that it will:

  • support more mediation;

  • look to simplify compromise agreements;

  • increase the conciliation role of ACAS;

  • shorten tribunal hearings; and

  • penalise employers breaching employment laws.

Notably, the Government has also announced a fundamental review of the procedural rules governing employment tribunals. In this briefing, Eversheds' Simon Rice-Birchall comments on the proposed changes and what they mean for businesses and employers.
