Race equality blocks planning application

Overview

A decision of the London Borough of Haringey to grant planning permission for the development of Wards Corner on High Road, Tottenham has been quashed by the Court of Appeal on the grounds that no regard had been given to mixed race residents.

This is the first case to decide that local authorities must assess the likely impact in race equality terms before authorising major developments.

The proposed development site was in an area made up of local independent traders with a mix of Turkish, Cypriot, Colombian and Afro Caribbean influences and currently incorporates an indoor market comprising 36 units, of which 64% of traders are from Latin America or are Spanish speaking. The planning permission granted by the Council allowed the demolition of the existing buildings and the erection of mixed use developments in their place, with access, parking and associated landscaping and public realm improvements.
