Public procurement and utilities – the new regulations

Overview

The Utilities Contracts (Amendment) Regulations 2009 came into force on 20 December 2009. These new regulations amend the existing Utilities Contract Regulations to give effect to the new European Directive on Remedies. They apply to a significant amount of works and services procured by utilities and by companies involved in providing transport services such as London Underground and TFL and Eurotunnel.

They also apply to airport and port operators and to oil and gas companies and mining companies. As before, these regulations only apply where financial thresholds for the works or services have been exceeded.
