Overview

The United States’ Restoring American Financial Stability Act of 2010 was passed on 20 May, minus an amendment which would have allowed private civil actions by investors for aiding and abetting under federal securities laws.

This article by Barlow Lyde & Gilbert analyses the position of lawyers, accountants, financial institutions and businesses carrying out business in, or having some connection with, the United States now the Act has been passed. It also discusses previous attempts to establish liability against such secondary actors, which been quashed by the courts.
