Overview
Adjudication is a useful tool for parties involved in construction disputes who are looking to resolve an issue, either during the course of or at the end of a project, as quickly and cost effectively as possible.
Whilst an adjudicator's decision can be challenged in court, the Technology and Construction Court (TCC) has made clear in a series of decisions that it will seek to uphold the decision unless it was made outside of the adjudicator's powers or in breach of natural justice.
Proposed changes to the law in this area should open up greater opportunities for the use of adjudication. This briefing by Eversheds examines the potential impact of those changes.
