Overview
Korean firm Kim & Chang presents an overview of recent cases regarding product liability in South Korea.
The examples looked at in more detail include cases in which:
- An insurance company paid the claim of an owner of an imported automobile which was destroyed by catching on fire, and then sued the automobile importer by alleging a defect in the vehicle;
- The plaintiffs alleged that a defective stereo system manufactured by a foreign company caused a fire and damaged their home, and thus sued the manufacturer's Korean subsidiary for damages; and
- Farmers who purchased tomato seeds from the defendant seed manufacturer argued that bacteria in the seeds ruined their harvest, and thus filed a product liability suit against the manufacturer.
