However, before proceedings can get underway, it must be ascertained as to whether a POA would be appropriate. The Civil Transactions Law (UAE Civil Code) states that the following criteria must apply:
● the principal (person issuing the POA) must have the right to act by him or herself in the matters entrusted to the attorney (i.e. the person to whom the POA is granted);
● the attorney must not be prohibited from acting in the matters entrusted to him or her; and
● it must be possible to delegate the matters that are the subject of the POA.
