Overview
One intention of the Coalition Government is to phase out the National Default Retirement Age (DRA), and on 29 July 2010 the Government announced that it intended to abolish the DRA on 1 October 2011.
In addition, it proposes to remove all associated statutory retirement procedures, including the duty on employers to give a minimum of six months’ notice of retirement to employees and the right of employees to request to work beyond the retirement age.
There has been much press speculation about the effect that this will have on employees: how will employers be able to plan their workforce; what effect will this have on the promotion prospects of junior employees; and how can employers dismiss older staff who are “no longer up to the job”?
This briefing looks at the actual terms of the proposals and what this will mean for employers who wish to retire members of their workforce.
