Korean chemical product suppliers set for tighter safety regulations

Overview

The Ministry of Employment and Labour (MOEL, formerly known as the Ministry of Labour) recently announced the partial draft amendment (the "Draft Amendment") to the Industrial Safety and Health Law (ISHL), under which the obligations imposed on the business owners who supply chemical products in relation to preparation and provision of MSDS and labelling are clarified for more stringent enforcement.

Under the current ISHL, business owners who intend to use, transport, or store (collectively referred to as handle) chemical substances, in addition to ones who intend to manufacture or import chemical substances, must prepare and place MSDSs and put relevant labels thereon. Such comprehensive obligations relating to MSDSs and labelling seem to be unreasonably imposed on all business owners who handle chemical substances in the sense that they may not be able to produce or obtain required information on the chemical substances.
