2. The Law Commission review of insurance contract law - Issues Paper No.7 - the insured's post-contract duty of good faith.
In its seventh issues paper, the Law Commission and the Law Commission of Scotland (the "Commissions") consider the extent of the insured's duty of good faith after formation of the insurance contract. The paper examines a range of issues in detail, but devotes most of its 78 pages to a detailed consideration of fraud and its consequences, before going on to very briefly consider other aspects of the insured's duties after formation of the insurance contract, perhaps the most significant being increase in risk clauses.
