Overview
On 26 January 2010, 18 months after the trial ended, the High Court handed down judgment in the BSkyB v EDS litigation, a case which has attracted a great deal of interest from the IT industry and lawyers alike. We set out in this note the key issues in the case and comment on the implications for suppliers and customers.
In March 2000, BSkyB sent an invitation to tender to EDS, PwC, Arthur Andersen, Andersen Consulting and Ernst & Young for a contract to upgrade BSkyB's customer contact centres with state of the art technology and processes, to be operational within 12 months. This upgrade was to include designing, building, managing and integrating a new customer relationship management system ("CRM System").
