Overview
Employment law in Brazil is very detailed and often inflexible, and equally applicable to foreign investors. As recruitment in Brazil needs to respect the local law, HR managers and those working with them are becoming increasingly involved with issues concerning employment law, and particularly in relation to the tricky issue of whether an individual has employment status or not.
Additionally, some worldwide policies can conflict with the applicable Brazilian rights, which are applied rigidly and can represent a challenge to international investors. Not only that, but access to employment tribunals is free, and employment claims are common (some 200,000 employment claims were lodged in 2010 in the city of Sao Paulo alone).
In this briefing, Wragge & Co's employment team provide an introduction to some of the most significant employment law issues in Brazil.
