In 2011, China's highest court issued an annual report providing the court's comments on various intellectual property cases across the country. The report is a closely-watched publication as it contains comments that hold considerable influence over the future direction of intellectual property law in China.
In this article, King & Wood take a look at how the court's comments shed light on China's patent, copyright, and trademark laws, as well as how intellectual property plays into issues of unfair competition and the rules of evidence. (As the full text judgments of several of these cases have yet to be released, the analysis is limited only to what has been made publicly available.)
