Illegal working - new guidance

Overview

The UK Border Agency has issued new guidance to employers in relation to the document checking process that employers should undergo prior to commencement of employment to ensure that their statutory excuse against a civil penalty for illegal working is established.

Firstly, a new guidance document specifically aimed at asylum seekers and refugees has been issued, and secondly, the UKBA have confirmed that with effect from 2 August 2010 an employer can accept an indefinite leave to remain stamp in an expired passport as evidence of right to work.
