ICC's new rules of arbitration enter into force in January 2012

Overview

The International Chamber of Commerce's International Court of Arbitration has launched the new ICC Rules of Arbitration, which will enter into force on 1 January 2012.


The essential features of arbitration under the ICC Rules remain mostly unchanged and some of the new provisions codify existing practice. However, other changes have been introduced to take into account developments in arbitration practice and procedure and to address the increasingly complex and diverse nature of today's disputes.


In this briefing, DLA Piper outline the new Rules' most significant and innovative amendments and clarifications, including:



  • enhancing the general efficiency of the arbitration process administered by the ICC Court;

  • responding to the need for urgent measures by creating an Emergency Arbitrator procedure; and

  • addressing issues arising in the context of multi-party or multi-contract arbitration.
