New ICC Arbitration Rules - an overview of the key changes

Overview

On 1 January 2012 the ICC's updated Arbitration Rules came into force. The 2012 Rules recast the arbitration process as a modern flexible procedure within which parties can adopt measures uniquely suited to each dispute.

The key examples of these changes are to be found in the measures promoting active case management and flexibility in procedure, including the new Appendix IV - Case Management Techniques. In addition, the ICC's ADR Rules are specifically included as a further supplement. In this briefing, Field Fisher Waterhouse outline each of these key changes, including a look at:

  • the role of the ICC Court;

  • jurisdiction challenges screening process;

  • appointment of arbitrators;

  • active case management and flexible proceedings;

  • timescale for award; and

  • emergency arbitrator.
