Hong Kong employment law update – statutory minimum wage, social media and liability for employers

Overview

The recent Hong Kong employment law update from Baker & McKenzie looks at the following:

• The Minimum Wage Ordinance came into force on 1 May 2011 establishing a statutory minimum wage for all employees.

• Three cases highlight how careless behaviour can create significant liability for employers (and in one case for the employees) therefore caution needs to be exercised when making public statements.

• The use of social media has grown exponentially over the last few years therefore it is unsurprising that information on social networking sites is being introduced into evidence in employment hearings to support misconduct dismissals. A French Labour Court recently had to determine whether comments posted on a user’s page on a social network site were private or not.
