Overview
The Ministry of Justice recently published the long-awaited consultation paper on the introduction of a fee charging regime in the employment tribunals and EAT. The consultation paper does not ask for views on whether fees should be charged, only on how the fee structure should operate. The introduction of fees seems to be inevitable. There are 2 options proposed for consultation:
● Option 1: which involves an issue fee and a hearing fee which will vary depending on the nature of the claim.
● Option 2: which involves an issue fee only, variable depending on the nature of the claim and the level of compensation sought.
