Overview

Baker & McKenzie’s monthly carbon capture & storage (CCS) newsletter highlights the recent assignments, legislative and regulatory changes in various jurisdictions:

Australia – Recent amendments to the Offshore Petroleum and Greenhouse Gas Storage (Safety Levies) Act 2003 introduce cost recovery levies on holders of offshore petroleum titles in respect of wells and well-related activities in those titleholders' title areas.

Europe - The CCS Directive (2009/31/EC) came into force in June 2009 and EU member states have until 20 June 2011 to transpose it into their national law.

United States - The US has issued two rules related to the capture and sequestration of carbon dioxide. The first rule sets out the minimum technical criteria for geologic sequestration whilst the second rule finalises greenhouse gas reporting requirements for facilities that carry out geologic sequestration.
