Overview
The European Commission recently published proposals for a Common European Sales Law. If the CESL becomes a reality, it will be possible to opt for certain contracts to be governed by a set of principles which would amount to a "European contract law". The CESL will, however, only apply to a limited range of contracts - so, for many businesses, it may not even be an option.
This briefing from Travers Smith explains what the draft CESL is and looks at the likely implications for business. Areas covered include the types of contracts covered; who the CESL is primarily for; how it will affect consumers and small-medium sized enterprises; problems with the CESL; and the draft's next steps.
