European competition policy - what to expect in 2012

Overview

This update from Baker & McKenzie's antitrust and competition team argues that the EU is currently in a "quieter" era of competition enforcement, with an apparent willingness on the European Commission's part to engage more in advocacy and in influencing companies to comply with European competition law - an approach that leads to faster results with fewer resources.

In spite of this, this article points out a number of likely developments in European competition law policy, including:

  • more focused cartel decisions;

  • private damages initiative;

  • technology transfer block exemption review;

  • more effective merger analysis;

  • dangers of Phase II investigations;

  • access to file; and

  • minority shareholdings.
