New EU privacy and data protection laws - implications and key points

Overview

On 25th January 2012, Commissioner Viviane Reding unveiled the European Commission's proposal for reform of the EU's privacy and data protection laws. The proposal aims to replace the current EU Data Protection Directive with a new legal framework that will lay the foundation for a Digital Single Market.


As its centrepiece, the proposal contrains a new draft General Data Protection Regulation which aims to strengthen individuals' privacy rights and create a "single set of rules on data protection across the EU". The proposal also includes a new Directive on processing personal data for the purposes of prevention, investigation and prosecution of crime. However, it is the draft General Data Protection Regulation that will have most impact on business.
