Equality Act 2010: public sector duties

Overview

This briefing from Eversheds analyses the Government Equalities Office’s recently launched consultation into the specific public sector duties that it intends to apply to certain public bodies pursuant to section 153 of the Equality Act 2010.

The proposals affect public bodies operating in England, as well as some public bodies operating across Great Britain in relation to non-devolved functions. The Scottish Government and the Welsh Assembly Government will issue separate consultation documents to set out their plans for specific duties for relevant Scottish and Welsh public bodies.

The specific duties will apply only to certain listed public bodies. Some of these are already listed in Schedule 19 of the Equality Act 2010 e.g. central government departments and NHS, local government and some educational bodies.

The consultation paper sets out proposals to extend the list to other organisations, including various non-departmental public bodies.
