Employment tribunal fees – a sensible reform or an unfair barrier to justice?

Overview

Following the Government's consultation into workplace dispute resolution earlier in the year, the Ministry of Justice recently published a consultation with more detailed proposals concerning employment tribunal fees.

In summary, the consultation puts forward two options for the introduction of employment tribunal fees. The first option would require an initial fee to lodge a claim then a second fee to proceed to a hearing. The second option would require those seeking an award above £30,000 to pay more to bring a claim.

In this briefing, Eversheds provide an overview of the consultation's background, the structure of the new fees and what it means for employers and claimants.
