Employment round up: agency workers, human rights and sick leave

Overview

With the publication of the new guidance on Agency Workers Reuglations, some long-standing questions about their scope and effect have now been addressed, but there are still a number of elements of uncertainty that are addressed in an article in this round up. In a second main article, the impact of the Human Rights Act is looked at. The Act has been much criticised in other contexts, but the piece argues that whatever its effect in other areas of law, its impact on the balance of power between employer and worker has been relatively modest. Another long-running topic is also addressed: the rights of workers on sick leave to accrue statutory holiday pay. There should be more news from the European Court of Justice to clarify this issue within the next year or so. In the meantime an advocate general’s opinion which points the way towards a compromise solution is discussed.
