Employers face transition to new social security regime

Overview

From 1 May 2010 a new social security regulation governing the treatment of migrant workers will be introduced, although the earlier regulation is likely to remain in effect for some time within the European Economic Area, including Switzerland, and with respect to third country nationals.

Although Regulation 1408/71 will be replaced by Regulation 883/2004 the older regulation will indeed remain in  force until agreements with the EEA countries are revised. It will also remain active for third country nationals until Regulation 859/2003 (which extends the old Regulation to third country nationals) is replaced.
