Where electronic disclosure meets the Bribery Act

Overview

With the introduction of the Bribery Act in the UK bringing in tighter controls with regards to monitoring and review, risk assessment and due diligence, companies may want to review their e-disclosure practices.

In addition to using reactive eDiscovery applications in a compliance sense, other information governance technologies can repurposed to help with anti-bribery activities. For example, Data Loss Prevention (DLP) technologies, which are typically used to detect the misappropriation of trade secrets, can also be deployed to find incidents of bribery and fraud.

These applications use machine learning across unstructured data to help find previously undetected examples of inappropriate conduct. These technologies create a fingerprint of exemplar documents (like emails, memos and contracts) and then can search the network information to find similar content.
