Education e-briefing: new powers to search pupils and students

Overview

There has been considerable coverage in the media of new powers which the
government is introducing to help staff in schools and colleges to deal with
inappropriate behaviour by pupils and students. This briefing explains both the new powers that will come into force on 1 September 2010 and also the government's plans for giving staff in schools and colleges further powers in the future.

From 1 September provisions in the Apprenticeships, Skills, Children and Learning Act 2009 will widen the powers of members of staff of schools and colleges to search pupils and students for prohibited items. From this date members of staff of schools and colleges in England who have reasonable grounds for suspecting that a pupil has a prohibited item with them or in their possessions may carry out a search for a prohibited item.
