Overview
The UK Government has this morning confirmed that it plans to abolish the default retirement age (DRA) next year. This briefing by Eversheds reports on the implications.
The aim is that from 6 April 2011 the statutory retirement procedure in Schedule 6 of the Employment Equality (Age) Regulations 2006 will be revoked, as will regulation 30 (or Schedule 9 paragraph 8 of the Equality Act 2010 as it is will shortly become) and ss98(2)(ba) and s98ZA-ZH of the Employment Rights Act 1996, which prevent retirement dismissals of employees being challenged as age discrimination and unfair dismissal respectively where key conditions are met as to notice and the procedures followed.
