High Court clarifies the scope of patent infringement by dealings in a kit of parts

Overview

UK High Court judge Mr Justice Arnold this week delivered his judgment in the latest instalment of the dispute relating to aircraft business class seats.

In Virgin Atlantic Airways Limited v Delta Airways Inc, the judge decided that an incomplete kit of parts could not constitute infringement where the assembly of the kit took place outside the UK.
