Court of Appeal hands down its decision in "Star Wars Stormtroopers" case

Overview

A look at the latest developments in the IP/IT sector, including the Court of Appeal's recent decision in Lucasfilm -v- Ainsworth, which ruled Star Wars Stormtrooper helmets are not "artistic" for the purposes of English copyright law.

The essentially territorial nature of intellectual property rights also meant that the Court would refuse to decide whether a foreign copyright had been infringed. The decision highlights that securing and enforcing foreign laws (and even judgments) is not straightforward.
