The Community Infrastructure Levy

Overview

For several years, the Government has been investigating means of requiring most developments to contribute towards the cost of providing new communal infrastructure.
A major step towards achieving this was taken with the enactment of the Planning Act in 2008. This included provisions for a "Community Infrastructure Levy" (CIL) but, although the Act set out the basic principles of the CIL, the detail was deferred to Regulations which had not then been prepared.
The Government has now published draft Regulations, together with a consultation paper so that the scope and operation of the CIL are now much clearer. The Regulations will come into effect in April 2010 (although CIL will not be charged for some time after that). The period for commenting on the draft Regulations and consultation paper expires on 23 October 2009.
