Common law manslaughter conviction – the case of R v Winter

Overview

The Corporate Manslaughter and Corporate Homicide Act 2007 creates a new statutory offence for corporate entities but does not create a new offence so far as individuals are concerned.

Individuals within a corporate entity can be prosecuted for manslaughter contrary to common law. The recent case of R v Winter [2010] EWCA Crim 1474 provides a recent example of the type of conduct which constitutes gross negligence leading to convictions for manslaughter.
