In this briefing, NCTM looks at how ADR in Italy is likely to grow significantly in the coming years due to the transposition into Italian law of EU Directive 2008/52/EC on civil and commercial mediation, which is expected to be adopted in 2010.

It is expected that the new rules will have a hugely beneficial impact on the famously slow Italian litigation process.

In addition to implementing the EU Directive, the new law will introduce a wider reform of all forms of mediation. The main features of the draft law (always subject to changes before final enactment) are set out in this article.
