Overview
The UK Cabinet Office has issued a consultation paper putting forward options for changing the deadline for commencing High Court actions under the Public Contracts and the Utilities Contracts regulations.
The proposed options would shorten the time limit for commencing such actions to as little as 10 days, running from the date when the claimant first knew, or ought to have known, of the alleged infringement.
The changes are necessary in order to bring the Regulations into line with the important ruling by the European Court of Justice in the Uniplex case earlier in 2010. Herbert Smith has the details.
