Overview

After an 18-month wait the High Court has handed down its judgment in BSkyB Limited and another (Sky) v HP Enterprise Services UK Limited (formerly Electronic Data Systems Limited) and another (EDS).

The decision is particularly significant for the IT sector and had been eagerly anticipated, owing to the potential ramifications for sales and procurement.

Although the High Court ruled in favour of Sky, the implications for IT suppliers generally may not be as radical as initially feared, although there is no doubt the decision will be an encouragement to dissatisfied customers to bring a challenge, and there will be greater focus on the accuracy of statements made during the tender process.
