The Court of Appeal has stated categorically that claimants in breach of contract equal pay claims can choose between bringing their claims in the civil courts and the more typical jurisdiction of the Employment Tribunals. In Birmingham City Council v Abdulla, the Court of Appeal also considerably reduced the scope of getting civil court claims struck out on jurisdictional grounds.
