Overview
The 'simplified procedure' for the abandonment and destruction of goods suspected of infringing intellectual property rights came fully into operation on 16 April 2010. At that time, HMRC issued draft guidance on how the simplified procedure would operate and a draft revision to Notice 34, the notice detailing how HMRC deals with IP rights.
In June, HMRC issued the final version of Notice 34. This briefing highlights a couple of key changes that were made to Notice 34 since the draft released in April, and discusses whether the 'simplified procedure' is,in practice, any simpler for those trying to protect their intellectual property rights.
